for natural persons of our suppliers, customers and other business partners

The protection of personal data is important for Sprecher Automation GmbH and its affiliated companies (hereafter collectively referred to as "Sprecher Automation"). Sprecher Automation processes personal data solely in accordance with the provisions of the General Data Protection Regulation (GDPR) and the applicable national provisions regarding the protection of personal data and data security.


For which purpose will personal data be processed?

Personal data of natural persons of our suppliers, customers and other business partners will be processed for the following purposes within the scope of Sprecher Automation's activities:

  • Communication, advice and training regarding Sprecher Automation's delivery and service portfolio in order to take steps prior to entering into a contract, e.g. to respond to queries, to prepare offers, or to hold training or workshops;

  • Communication, advice and training, research and development, planning, design, production and processing, as well as trade, assembly, commissioning, project or construction site setup, renting, repair, maintenance, procurement and storage for the performance of a contract, e.g. for the delivery of products, to provide services, to implement projects, to render administrative tasks, inter alia accounting and dunning process;

  • for compliance with legal obligations, e.g. compliance with statutory obligations, inter alia storage period in accordance with tax and commercial law, compliance with obligations under corporate law, inter alia Sprecher Automation's compliance guidelines;

  • to safeguard legitimate interests, e.g. in order to assert contractual or statutory rights, to settle legal disputes, to comply with safety requirements regarding products and services as well as for direct marketing purposes.

We would like to keep our suppliers, customers and other business partners informed by e-mail of events and fairs, as well as of the latest news related to our company and our products. Therefore, we request your consent, which can be given here.


Which categories of personal data will be processed?

If necessary, following categories of personal data will be processed in order to achieve the purposes stated above

  • contact information, e.g. first name and surname, telephone number, fax number, e-mail address, name of department and/or function;
  • company information, e.g. company name and address, Commercial Register details, bank details, VAT ID;
  • other information, e.g. information that has been provided or is required in order to take steps prior to entering into a contract and for performance of the contract, such as query and order documentation, business correspondence;
  • public information, e.g. from creditor protection associations or business registers;

Personal data will be processed if necessary for the corresponding purposes or if they have been disclosed by natural persons of our suppliers, customers and other business partners.


What are the legal bases for processing personal data?

Legal basis for processing personal data is, if applicable:

  • Article 6 (1) a) GDPR consent to the processing for one or more specific purposes
  • Article 6 (1) b) GDPR in order to take steps prior to entering into a contract and/or performance of a contract
  • Article 6 (1) c) GDPR compliance with a legal obligation
  • Article 6 (1) f) GDPR to safeguard legitimate interests

In particular cases, a divergent legal basis may be required.


To whom will personal data be transmitted?

If necessary, personal data will be transmitted to affiliated companies of Sprecher Automation GmbH, to processors (e.g. IT service providers), as well as to third parties (e.g. authorities, legal advisers, courts) if this is permissible or required in order to fulfil a legal obligation.


How long will personal data be stored?

Personal data will be stored for the duration of the fulfilment of the purpose or for the duration of the fulfilment of Sprecher Automation's statutory or contractual duties.


What are the rights for data subjects?

Data subjects have the right of access, to rectification, to erasure, to restriction of processing, to data portability, to object, to automated individual decision-making, including profiling and a right to lodge a complaint with a supervisory authority, if any.
